Can you clarify whether it would count if the agency action implementing the executive order is found not to comply with the APA? I think the President is not bound by the APA, so I'm not sure whether an Executive Order itself could be overturned. However the EOs generally will instruct a person or agency in the government to take an action, and those actions could be overturned under the APA.
